GameStop Machinima Contest Presented by The United States Navy featuring SKATE Official rules
No Entry Fee is Required to Participate in or Win this Contest.
1. The "GameStop Machinima Contest" presented by The United States Navy (the "Contest") begins at 7:00 a.m. Pacific Standard Time (PST) on October 1, 2007 and ends 3:00 p.m. PST on November 30, 2007 ("Contest Period"). Online access via Contest Web site is required for detailed information, instructions and entry.
2. Eligibility: Contest is offered only in the United States to Legal Residents of the 50 United States, including the District of Columbia, who are at least 18 years old at the time of entry, have internet access and who own or have access to a copy of the video game SKATE. Employees of GameStop, Inc., Electronic Arts Inc., Machinima.com, Channel M and The United States Navy, its affiliated and subsidiary companies, advertising and promotional agencies, Webmasters and Web suppliers and the immediate family (spouse, mother, father, sister, brother, ward, daughter or son) or members of the households of such employees or directors (whether or not related) (collectively, the "Releasees") are not eligible to enter the Contest or win a prize. By entering, you agree to be bound by these Official rules and the decisions of Sponsor, which are final and binding in all respects. Winner will be required to complete an Affidavit of Eligibility. Void where prohibited.
3. To Enter: Go to www.gamestop.com/navy (the "Web site ") to review Contest rules, guidelines and register for the Contest.
6. Prizing:
ONE (1) GRAND PRIZE: Sponsor will award one (1) Grand Prize: A trip for two to Dallas, Texas. The grand prize trip must take place between January 3, 2008 and January 5, 2008. There is no cash substitute and the trip must originate from the fifty United States or the District of Columbia. The trip will include: Two (2) roundtrip coach tickets for the winner and one (1) guest. The winner and guest will be flown from the airport closest to the winner’s residence OR from an airport within 50 miles of the winner’s residence to Dallas, Texas. Approximate Retail Value (ARV) $2,000.00), two (2) nights lodging to include all hotel taxes, double occupancy at a hotel designated by the Prize Provider in its sole discretion. (ARV: $500.00), two (2) day rental car to include all applicable taxes and insurance and by a rental provider designated by the Prize Provider in its sole discretion (ARV: $125.00), two (2) tickets to the Dallas Mavericks NBA home game on January 4, 2008 against the Miami Heat at the American Airlines Center in Dallas, Texas, (ARV: $1,000.00), Cash for meals and or incidentals ($500.00), One (1) $500 GameStop gift card and One (1) commemorative plaque ($200.00). Total ARV of prize package: $4,625.00. No more than the stated number of prizes will be awarded. Excludes hotel incidentals whereby winner must provide credit card or debit card upon check in to cover any hotel room incidentals they may accrue.
7. Winners: The selected potential winner will be notified by e-mail and telephone number provided on registration page within seventy-two (72) hours of the close of the Contest Period. The potential winner will have forty-eight (48) hours from the moment such notification is issued to respond to such notification by following the instructions provided therein. If a potential winner timely responds to such notification, he/she may then be sent an affidavit of eligibility, an image/media release and a liability/publicity release by e-mail and must complete, sign and return all required documentation within forty-eight (48) hours of issuance. If the potential winner does not reply to the notification within forty-eight (48) hours of its issuance or does not return the signed documents within forty-eight (48) hours of their issuance (if applicable), he/she is ineligible, or he/she cannot or does not comply with these official rules, he/she will be disqualified, the prize will be forfeited, and an alternate winner may be selected, at Sponsor’s discretion. In the event of noncompliance with either the rules or any of these time periods, an alternate winner will be selected. By entering this Contest and/or accepting the prize, all entrants consent to the use of their names, voices, pictures or other likeness for advertising, promotional and other purposes as determined by Sponsor and its designees without further approval or compensation (including on Sponsor’s Web sites). Sponsor has the right to revise dates and procedures stated in these rules. Winner must be prepared to travel to Dallas, Texas on January 3, 2008 and return to their original departure city on January 5, 2008. The Sponsor, at its sole discretion can modify and or change the prizes without prior notification and reserves the right to substitute any prize of equal or greater value. prizes will be fulfilled no later than 8-10 weeks after the conclusion of the Contest. Taxes and any costs associated with the receipt of the prize are the responsibility of the prize winner. All applicable federal, state and local taxes on prizes are the sole responsibility of the prize winner. Prizewinners whose prize package exceeds $600.00 will be required to complete a W-9 tax form.
8. General: All participants, by entering, agree to release and hold harmless Sponsor, GameStop, Machinima.com, Electronic Arts Inc. and The United States Navy and Releasees from and against any and all liability for injuries and/or damages sustained in connection with this Contest. All decisions of the Sponsor on all matters relating to this Contest are final. Prize cannot be exchanged, redeemed for cash or transferred and there are no substitutions. If, for reasons beyond the Sponsor’s control, the Contest is not capable of running as originally planned, the Sponsor, at its sole discretion, reserves the right to cancel or modify the Contest. Sponsor will not be responsible for lost, late, misdirected, damaged, or postage due mail, or for Internet, computer hardware and software, phone, and other technical errors, malfunctions, and delays. IN NO EVENT WILL THE SPONSOR OR RELEASEES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND USE OF THE INTERNET SITE http://www.Machinima.com. OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE. In the event of any dispute, entries made by Internet will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. Authorized account holder is deemed as the natural person who is assigned to an e-mail address by an internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If the potentially winning entry is an Internet or other computer entry, potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the potentially winning entry.
9. Cheating: Participants agree not to knowingly damage or cause interruption of the Contest and/or prevent others from utilizing the Contest. CAUTION: ANY ATTEMPT TO DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PARTICIPANTS MAKING SUCH ATTEMPT AND SPONSOR MAY SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW. This Contest and these Official rules are governed, construed and interpreted under the laws of the state of Texas and any or all claims pursuant to these shall be brought in the courts of the state of Texas. 4. Participation:
- Limit one (1) person (author) per entry. Multiple entries are permitted, but each must be submitted entirely separate from any other entry.
- Contestants must be at least 18 years old at the time of entry.
- All personal customer data will be uploaded to GameStop.com. After customer data is entered, all videos and related descriptions: will be uploaded directly to Machinima.com.com as part of the entry process; will become the exclusive property of GameStop and Electronic Arts; and, will not be returned.
- All entries (submissions) must be submitted via upload onto the Web site between 7:00 a.m. PST on October 1, 2007 and 3:00 PST on October 31, 2007 ("Entry Period"). Submissions must incorporate the following guidelines: Submit a video recording (in WMV, MOV or AVI format, maximum file size of 30 mb, maximum length 2 minutes) which incorporates some element of SKATE gameplay. Only submissions using the created customer character functionality of the game may be utilized. Users may not use the existing in game characters or feature them in their video. If the entrant chooses to use in game music featured in SKATE only the following artist's songs may be utilized: Z-Trip, XXXChange and Tommy Guerrero and may not be altered or remixed. Entries that feature any other in game music or use existing in game characters will be automatically disqualified.
- Entries received via the Web site after 3:00. PST on October 31, 2007 will be deemed ineligible for participation in the Contest. Any attempt at entry except as above stated is void.
- By submitting an Entry: (a) you represent and warrant that your Entry is wholly original, not previously published, and does not incorporate or include anything that is owned by any third party or would require the consent of any third party and your Entry does not violate any copyright, trademark, publicity right, privacy right or any other right of any third party; (b) you agree that your Entry shall be a "work made for hire." Notwithstanding this subsection, entries may contain content, game play and music from SKATE for PlayStation®3 and Xbox 360.
- EA grants entrants of this contest a limited license to download and use only the following video and audio assets from the game for the sole purpose of creating a Machinima video for submission in this contest: video footage of generic character models, in game environments, and in game sound effects and audio excluding all in game music except for in game music by the following artists - Z-Trip, XXXChange and Tommy Guerrero (which is the only music that entrants should use for their contest submissions). Due to EA's licensor restrictions certain elements of SKATE should not be included in video for submission in this contest. In particular, this includes any pro skater featured in the game, any skate equipment or clothing brands featured in the game, or any in game music (other than in game music by the artists listed above). Entrants who use and submit a submission which includes the following assets will be disqualified: any pro skater featured in the game, any skate equipment or clothing brands featured in the game, or any in game music (other than in game music by the artists listed above).
- All entries become the property of GameStop, Inc. and as such, can be used in any manner deemed fit by GameStop and will not be returned. By submitting an entry you irrevocably assign to GameStop all right, title and interest in your entry, photo and audio and/or video with the right to make any and all uses thereof throughout the world in perpetuity, including, without limitation, for purposes of advertising, marketing, promotional and other purposes as determined by GameStop and its designees in any and all media whether now known or hereafter devised without further approval or compensation. The rights granted under this paragraph shall extend to all entries and all other submitted materials related to the Contest, including those submitted by non-winners and winners.
- Sponsor assumes no responsibility for illegible, lost, delayed, misdirected or incomplete entries, system errors and failures, faulty transmissions, or other telecommunications malfunctions.
