Rules / Prizes

1. The "Bourne Ultimatum Machinima Trailer Contest" presented by Universal Picture's motion picture entitled "Bourne Ultimatum" and Machinima.com (the "Contest") begins at 12:00 a.m. Pacific Time ("PT") on July 16, 2007 and ends at 11:59 p.m. PT on September 5, 2007 ("Contest Period"). Online access via Contest website (as detailed below) is required for detailed information and instructions. 

  • Submission Period:
    • July 16, 2007 through August 20, 2007
  • Voting Period:
    • August 25, 2007 through September 02, 2007
  • Winners will be announced on September 09, 2007.

2. Eligibility: Contest is offered only in the United States to Legal Residents of the 50 United States (including the District of Columbia) and in Canada (excluding Quebec), who are at least eighteen (18) years old, and of majority age in jurisdiction of legal residency at the time of entry and have Internet access. If you are under the age of majority, you must have your parent's or legal guardian's permission to participate in this Contest. 

Employees, producers and directors of Machinima, Inc., (the "Sponsor") and Universal City Studios LLLP ("Universal") (collectively the "Promotion Parties"), their respective affiliated, parent and subsidiary companies, advertising and promotional agencies, Webmasters and Web suppliers and the immediate family members (spouse, mother, father, sister, brother, ward, daughter or son) or members of the households of such employees or directors or family members (whether or not related) are not eligible to enter or win a prize. By entering, you agree to be bound by these Official rules and the decisions of Sponsor, which are final and binding in all respects. 

3. To Enter: During the Contest Period, go to http://www.machinima.com/bourne (the "Web Site") to review Contest rules, and guidelines, register for the Contest, read information on how to enter the Contest and enter the Contest.  By entering, you agree to all the official rules contained herein as well as the rules contained in the contest submission form . 

4. Participation: 

   1. Limit one (1) person (author) may be named on any one (1) entry. Multiple entries from the same person are permitted, but each must be submitted entirely separate from any other entry.

   2. Contestants must be at least eighteen (18) years old at the time of entry and of majority age in jurisdiction of legal residency at the time of entry and have Internet access. If you are under the age of majority, you must have your parent's or legal guardian's permission to participate in this Contest.

   3. All entries (submissions) must be submitted via upload and received on the Web Site during the Contest Period.

 To enter, submit/upload the following as directed at the Web Site:

          * a machinima video recording (in WMV, MOV or AVI format, maximum file size of 30 mb) of your machinima version of the official "Bourne Ultimatum" trailer for which we have provided the audio and graphics.  

5. Entries received via the Web Site after 11:59 p.m. Pacific Time on August 20, 2007 will be deemed ineligible for participation in the Contest. Any attempt at entry except as above stated is void. 

6. By submitting an entry you irrevocably assign to Machinima, Inc. (.Machinima.) the right to display, modify and edit your entry for the purposes of promoting and advertising your entry and the Contest.  By entering, entrants agree to be bound by these Official rules including all eligibility requirements. By accepting a prize, winners consent to the use of their names, images, likenesses, photo, voices, and biographical materials for advertising, publicity, and promotional purposes by Machinima, Universal, or a party designated by Machinima or Universal, including but not limited to, any online announcements, without additional notice or compensation, except where prohibited by law. Entrants agree that any and all disputes shall be governed by the laws of the State of California. Entrants agree that the conditions of submission set forth in these Official rules, and all documents and agreements incorporated in these Official rules by reference, solely govern the relationship between entrants and Sponsor in connection with this Contest. 

7. Promotion Parties assume no responsibility for illegible, lost, delayed, misdirected or incomplete entries, system errors and failures, faulty transmissions, or other telecommunications malfunctions. Sponsor reserves the right, at its sole discretion, to cancel, terminate or suspend the Contest should any unauthorized intervention or other cause beyond the control of the Sponsor affect the administration or conduct of the Contest. 

8. The rights granted under this paragraph shall extend to Machinima, Universal and their respective affiliated companies with respect to all entries and all other submitted materials related to the Contest, including those submitted by non-winners and winners.  

9. Judging Criteria: One First Place Winner, one Second Place Winner and one Third Place Winner will be chosen by the online community, via a provided voting/rating system, with final approval/selection by the Sponsor. All decisions by the Sponsor are final.  In the event of a tie, the Sponsor will make the final decision. 

Starting at midnight, August 24, 2007 (that being 0:00:00 A.M. PDT), anyone can simply go to the video finalists page, review a video, and rate the video by clicking on the stars.  Voting will end on 11:59 p.m. Pacific Time on September 2, 2007.  

You can only rate a video once. If you change your mind about your rating, the most recent rating you selected will be calculated into the total, and your previous selection will be removed. So voting a hundred times for your own video isn't going to help you. 

At the end of the voting period, we may have clear winners, or we may not. Our contest staff will, if necessary, apply a fair mathematical algorithm which will give a slight, additional weight to entries with more votes. This is to prevent a 5.0 winner with one vote from winning over a 4.9 average rating with 100 votes, for example.  

We may also enable, if necessary, a program to prevent low-vote abuse. In other words, we would like to discourage you from voting for one video with a 5 and all other videos with a 1 to throw the system off balance. If we see low-vote abuse, we reserve the right to withdraw all votes from the offending user, and/or disqualify any entry associated with that user. In the event of a tie, the Sponsor will make the final decision. 

In order for ratings to work, you must have JavaScript and browser cookies enabled. 

10. prizes:  

 
  • 1st place: a gift card or cash prize in the amount of $500 (USD) and a Bourne Ultimatum Prize Pack.
  • 2nd place: a gift card or cash prize in the amount of $350 (USD) and a Bourne Ultimatum Prize Pack.
  • 3rd place: a gift card or cash prize in the amount of $150 (USD) and a Bourne Ultimatum Prize Pack.

Redemption of all prizes are subject to redemption terms and conditions of the specific retailer or service provider. 

All taxes and any other costs and expenses not specifically stated within these Official rules are the sole responsibility of the winners.  prizes may not be transferred, exchanged, substituted or redeemed for cash, except at Machinima's sole discretion. Specifics of the prizes are in Machinima's sole discretion. prizes are subject to availability and Sponsor reserves the right, in its sole discretion, to award a prize of equal or greater value if advertised prizes or a portion of the prizes is unavailable.

 

All winners must sign, complete and return a notarized Release of Liability, Affidavit of Eligibility and (except where prohibited) a Publicity Release and an IRS #W-9 form before receiving any prize.   This Contest is governed by U.S. law and is subject to all federal, state, and local laws and regulations. Void in Puerto Rico, all U.S. territories and possessions, overseas military installations and wherever prohibited by law. Any and all other costs, fees, taxes and expenses not explicitly stated herein as being awarded, are the sole responsibility of the prize recipient. 

11. Winners: The selected potential winners will be notified by email or telephone within twenty-four (24) hours of the close of the Contest Period. The potential winners will have forty-eight (48) hours from the moment such notification is issued to respond to such notification by following the instructions provided therein. If a potential winner timely responds to such notification, he/she may then be sent an affidavit of eligibility and a liability/publicity release by email, and must complete, execute and fax all required documentation within forty-eight (48) hours of issuance as well as mail all required documentation within ten (10) days of issuance. If the potential winner does not reply to the notification within twenty-four (24) hours of its issuance or does not fax the executed documents within forty-eight (48) hours of their issuance (if applicable), he/she is ineligible, or he/she cannot or does not comply with these official rules as determined by Sponsor, he/she will be disqualified, the prize will be forfeited, and an alternate winner may be determined, at Sponsor's discretion. In the event of noncompliance with either the official rules or any of these time periods, an alternate winner may be determined at Sponsor's discretion. Sponsor has the right to revise dates and procedures mentioned in these rules. 

All entrants represent and warrant that any material that he or she submits is entrant's original creation (except for material(s) furnished by Sponsor), has not been previously published or won an award, does not infringe upon the copyright or any other right or interest of any other person or organization, and that the entrant has not previously granted any rights to such material to any other person or organization, nor does any third party have any interest in such materials.  Sponsor reserves the right to conduct background checks on any Contest winner and to verify the accuracy or legitimacy for truthfulness of any information contained within the submitted entry.  Sponsor and Universal will be the sole, exclusive and perpetual owner of the submitted videos, which ownership entitles Sponsor and Universal, among other things, to all right, title and interest in the copyright in and to the submitted video. By entering this Contest, entrants (i) agree that all entries and any other materials submitted (whether acceptable or not, regardless of the form they take) will be owned exclusively by Sponsor, (ii) waive all rights of droit moral and other rights of authorship in and to the material submitted, and (iii) grant Assignees (as defined below) the absolute and exclusive right and permission to edit, modify, publish, exploit and use the content of and elements embodied in the entry and the entry itself worldwide in perpetuity in any and all media (whether now existing or hereafter devised) and in any manner, for trade, advertising, promotional or any other purposes without further approval, permission or consideration.  Entrant further warrants and represents that none of the elements comprising the entry nor the performances embodied thereon, nor any other materials submitted by Entrant, nor any use thereof by Sponsor, or its grantees, licensees or assigns will violate or infringe upon the rights of any third person or entity. Entrants also agree that Sponsor, Universal, their respective affiliated and subsidiary companies, licensees, designees, successors and assigns (collectively, "Assignees") shall have the right and permission to use the name, city and state of residence, signature, voice, picture or other likeness, entry, entry information and/or entry submission of entrant in any manner or media now or hereafter known (including, without limitation, placing entrant's name, signature, entry, and/or entry information onto the Sponsor's or Universal's web sites or other site(s) promoting this Contest) without further consideration or notification to or permission from entrant or any third party, except where prohibited by law.   Entrants hereby assign all their right, title, and interest in and to the entry Submission and other Contest elements to Assignees, in perpetuity throughout the universe. 

12. LIMITATION OF LIABILITY: ENTRANTS HEREBY AGREE TO RELEASE, INDEMNIFY, AND HOLD HARMLESS THE PROMOTION PARTIES AND THEIR RESPECTIVE AFFILIATES, SUBSIDIARIES, PARENT AND RELATED COMPANIES, ADVERTISING AND PROMOTION AGENCIES, EMPLOYEES, OFFICERS, DIRECTORS, SHAREHOLDERS AND AGENTS (COLLECTIVELY, THE "RELEASEES") FROM ANY CLAIMS, ACTIONS, INJURY, LOSS OR DAMAGE OF ANY KIND, INCLUDING BUT NOT LIMITED TO, PERSONAL INJURY OR DEATH, RESULTING FROM PARTICIPATING IN THIS CONTEST, INABILITY TO PARTICIPATE IN THIS CONTEST OR FROM THE ACCEPTANCE, POSSESSION, OR USE OR MISUSE OF ANY PRIZE AWARDED OR PARTICIPATION OR INABILITY TO PARTICIPATE IN ANY PRIZE-RELATED ACTIVITY. THIS LIMITATION OF LIABILITY IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING (WITHOUT LIMITATION) COMPENSATORY, DIRECT, INDIRECT, OR CONSEQUENTIAL DAMAGES; LOSS OF DATA, INCOME, OR PROFIT; LOSS OR DAMAGE TO PROPERTY; AND CLAIMS OF THIRD PARTIES. PARTICIPANTS AGREE THAT RELEASEES HAVE NOT MADE NOR IS IN ANY MANNER RESPONSIBLE OR LIABLE FOR ANY WARRANTY, REPRESENTATION, OR GUARANTEE, STATUTORY, EXPRESS OR IMPLIED (INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, AND FITNESS FOR A PARTICULAR PURPOSE), IN FACT OR IN LAW, RELATIVE TO THE CONTEST. WITHOUT LIMITING THE GENERALITY OF THE FOREGOING, MACHINIMA DOES NOT MAKE ANY EXPRESS OR IMPLIED WARRANTIES OR REPRESENTATIONS WITH RESPECT TO THE WEB SITE AND MACHINIMA SHALL NOT BE LIABLE FOR THE CONSEQUENCES OF ANY INTERRUPTIONS OR ERRORS RELATED THERETO. THESE TERMS GIVE YOU SPECIFIC LEGAL RIGHTS. THE PROVISIONS REGARDING IMPLIED WARRANTIES ARE VOID IN SOME PROVINCES WHERE IMPLIED WARRANTIES ARE PRESCRIBED BY LAW. Releasees are not responsible for lost, late, illegible, damaged, or stolen entries or submissions, or problems of any kind, whether mechanical, human or electronic. Releasees are not responsible for technical, hardware or software malfunctions, telephone failures of any kind, lost or unavailable network connections, inability to access a website, fraud, incomplete, garbled, or delayed computer transmissions or inaccurate transcription of entry information, whether caused by Machinima, users or by any of the equipment or programming associated with or utilized in this promotion or by any technical or human error which may occur in the processing of submissions which may damage a user's system or limit a participant's ability to participate in the promotion. Entry materials that have been tampered with or altered are void.  Machinima reserves the right, in its sole discretion, to cancel or suspend part or all of this Contest, or modify these Official rules at any time without notice, if in the Sponsor's opinion there is any suspected or actual evidence of electronic or non-electronic tampering with any portion of the Contest, or if virus, bugs, non-authorized human intervention or other causes corrupt or impair the administration, security, fairness or integrity and proper play of the Contest. In such event, Machinima may void any entries they suspect are at issue and award prizes from among all eligible entries received up to the date of cancellation. WARNING: ANY ATTEMPT BY AN ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE THE WEB SITE OR ANY ONLINE SERVICE RELATED TO THIS PROMOTION OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEY'S FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING CRIMINAL PROSECUTION.  Machinima's failure to enforce any term of these Official rules shall not constitute a waiver of that or any other provision. Machinima reserves the right to disqualify entrants who violate the rules or interfere with this Contest in any manner. If an entrant is disqualified, Machinima reserves the right to terminate that entrant's eligibility to participate in the Contest. Any attempts by an individual to access any web site associated with this competition via a bot script or other brute force attack or any other unauthorized means will result in the IP address and all entries from that IP address becoming ineligible. Use of automated entry devices or programs is prohibited.

13. Cheating: Participants agree not to knowingly damage or cause interruption of the Contest and/or prevent others from utilizing the Contest. CAUTION: ANY ATTEMPT TO DAMAGE OR UNDERMINE THE LEGITIMATE OPERATION OF THE COMPETITION VIOLATES CRIMINAL OR CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, SPONSOR MAY DISQUALIFY ANY PARTICIPANTS MAKING SUCH ATTEMPT AND SPONSOR MAY SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW. This Contest and these Official rules are governed, construed and interpreted under the laws of the State of California and any or all claims pursuant to these shall be brought in the courts of the State of California. Any provision of these rules deemed unenforceable will be enforced to the extent permissible, and the remainder of these rules will remain in effect.
